Terms of Use
These terms are the agreement between you and ExecutorPlus, Inc. (“we”, “us”) for the RoamGauge app. RoamGauge is a Kinship360 app; Kinship360 is a brand of ExecutorPlus, Inc. By installing or using RoamGauge you agree to these terms. If you do not agree, do not use the app.
1. What RoamGauge is, and what it is not
RoamGauge is a diagnostic tool. It sends small test connections to reference servers, public services and any servers you add, then reports whether the network you are on lets them through and what you can do about it.
RoamGauge is not a VPN. It never creates a VPN tunnel, never routes or carries your traffic, and does not change or get around any network's rules. When it checks a VPN server it performs only the opening handshake, to prove the server can be reached, and then closes the connection.
Results describe the network at the moment of the test. Networks change, so a result is information, not a promise.
2. Using RoamGauge responsibly
- Use RoamGauge only on networks you are allowed to use, and follow the rules of those networks and the law where you are.
- Only add servers and custom checks that you own or have permission to test. RoamGauge contacts them directly from your phone.
- If you add a WireGuard configuration that another device is using at the same time, the test can briefly interrupt that device's connection. It usually recovers on its own the next time that device sends traffic.
- Do not use RoamGauge to attack, overload, scan or interfere with any network, server or service, or to try to break into anything.
3. Where RoamGauge is available
We do not offer RoamGauge in every country. You may not use it where doing so is against local law. You confirm that you are not located in a country subject to a US Government embargo or designated by the US Government as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
4. Free and Paid
The core check is free. Paid is an optional subscription that adds features described in the app.
- Where you buy it. Paid is sold through the store you installed the app from: the App Store on iOS, Google Play on Android. That store takes the payment, and its terms also apply to the purchase.
- Price. The plan, its length and its price in your currency are shown in the app before you confirm. We never show an estimated price; if the store has not sent one yet, you cannot subscribe until it does.
- Free trial. A trial applies only when the offer shown in the app says so. The store decides who is eligible, usually one trial per account. If you do not cancel at least 24 hours before the trial ends, the subscription starts and you are charged. If you subscribe during a trial, any unused part of the trial ends.
- Payment. Without a trial, payment is charged to your Apple ID or Google Play account when you confirm the purchase. The store, not us, emails your receipt and any renewal notices.
- Automatic renewal. The subscription renews for the same length and price unless you turn off auto-renew at least 24 hours before the current period ends. Your account is charged for the renewal within the 24 hours before the period ends.
- Cancelling. Manage or cancel in your Apple ID subscription settings on iOS, or under Payments & subscriptions in Google Play on Android. Deleting the app does not cancel the subscription. After you cancel, Paid stays active until the end of the period you already paid for.
- Refunds. The store you bought from handles refunds under its own rules. We cannot issue refunds ourselves.
- Price changes. If the price changes, the store tells you first and, where its rules or the law require it, asks for your agreement before charging the new price.
- Family Sharing. Where the App Store listing says so, Paid can be shared with your Family Sharing group.
- Restoring. Use “Restore purchase” in the app to unlock Paid on a new device signed in to the same store account.
- Changes to Paid. We may add, change or remove Paid features. If we remove one, the free core check stays available.
5. Anonymous contributions
You can choose to contribute anonymous results from public networks. This is off until you turn it on in Settings, and you can turn it off at any time. The Privacy Policy lists exactly what a contribution contains. By contributing, you give us a free, permanent, worldwide permission to store, combine, analyse and publish those results, usually as summaries such as how a type of venue tends to behave. Because a contribution carries no identifier, we cannot find a particular one later to delete it.
6. Updates
RoamGauge downloads updated lists of test servers and advice rules from our server so its checks stay current. These are data, not new code. App updates come through the store.
7. Other companies' services
Speed tests use Cloudflare, or OVH if Cloudflare cannot be reached. Identity lookups use ipinfo.io through our server. Purchases are processed by the App Store or Google Play and checked by RevenueCat. Links to other companies' status pages or products open in your browser and are covered by their terms. If a link is a paid referral, the app says so next to it, and a referral never affects a result, a score or the advice the app gives.
8. Names and trademarks
RoamGauge names other products, such as VPN services and streaming apps, only to tell you whether they work on your network. Those names belong to their owners. Naming them does not mean they endorse or are connected with RoamGauge. The RoamGauge app, name and design belong to ExecutorPlus, Inc. We give you a personal, non-transferable licence to use the app on devices you own or control, under these terms and the store's rules. Do not copy, resell or reverse-engineer the app except where the law allows it.
9. No warranty
RoamGauge is provided “as is” and “as available”. A green result means a test got through at that moment. It is not a promise that any service will work, now or later. To the fullest extent the law allows, we make no warranties, express or implied, including fitness for a particular purpose and non-infringement.
10. Limits on our liability
To the fullest extent the law allows, we are not liable for indirect, incidental or consequential losses, or for losses caused by relying on a result. That includes missed calls or meetings, lost work, and roaming or data charges from tests you choose to run on cellular. Our total liability for any claim about RoamGauge is limited to the greater of what you paid for Paid in the 12 months before the claim, or USD 50.
Nothing in these terms takes away rights you have under consumer law that cannot be waived.
11. Apps downloaded from the App Store
If you got RoamGauge from Apple's App Store, these extra terms also apply:
- These terms are between you and ExecutorPlus, Inc. only, not Apple. We, not Apple, are solely responsible for RoamGauge and its content.
- Your licence to use RoamGauge covers Apple-branded devices that you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions. Family Sharing may also allow access.
- Apple has no obligation to provide maintenance or support for RoamGauge.
- If RoamGauge fails to meet any warranty that applies to it, you can tell Apple, and Apple will refund the price you paid for the app, if any. To the extent the law allows, Apple has no other warranty obligation for RoamGauge. Any other claims, losses or costs from a failure to meet a warranty are our responsibility, to the extent these terms do not disclaim them.
- We, not Apple, are responsible for handling any claims about RoamGauge or your use of it. That includes product liability claims, claims that it fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If anyone claims that RoamGauge or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and resolving that claim.
- You must follow any third-party terms that apply when you use RoamGauge, such as your mobile carrier's or your Wi-Fi network's terms.
- Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept these terms, Apple has the right to enforce them against you as a third-party beneficiary.
12. Ending
You can stop using RoamGauge at any time by deleting it; Settings → Your data deletes your history first if you want. Deleting the app does not cancel a subscription (see section 4). We may stop offering RoamGauge, or stop your use of it if you break these terms. If we discontinue the app, any Paid subscription can be cancelled through the store as described above.
13. Governing law
These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. Any dispute goes to the state or federal courts located in Delaware. If you live in a country whose consumer law gives you the right to bring a claim in your local courts, or to rely on protections of your local law, that right is not affected.
14. Changes and contact
We may update these terms. When we do, the effective date at the top changes, and the app always links to the current version. If a change materially affects your rights, we will give notice before it applies, on this page and where we can in the app. If any part of these terms cannot be enforced, the rest still applies. These terms and the Privacy Policy are the whole agreement about RoamGauge.
